Basic Info

BASIC INFO

1. Fees are charged by stages, for example Gazette stages will be charged approximately 9 to 12 months after date of application.

2.On average , Certificate of Registration obtained approximately within 18 months from date of application assuming on straight forward case.

3. Registration is valid for a period of 10 years from date of application and renewable every 10 years.

4. Malaysia is following NICE Classification of Goods and Services. No multi application . 1 Mark 1 Class.

PROCEDURE

A. Search (Optional)
To check the availability and registrability of your trademark in Malaysia.

B. Application.

The following documents required:
1. Form Statutory of Declaration (SD) to be executed by the applicant and attested by a
Notary Public. No need to be legalised by the Embassy. Scan the SD to us and
self keep the original.
2. Sample of the mark.
3. Certificate of Registration of the Company or Copy of the Passport (for individual)
4. Payment to be made via Telegraphic Transfer .

C . Gazette and Certificate
Once Notice of Acceptance is received from Trademark Registry, we will arrange your trademark for publication in Government gazette for 2 months. Should NO opposition raised within the period, registration certificate will be issued you thereafter.

What happen after the Trade Mark application is lodged ?


The Intellectual Property Department will issue a receipt containing the date of filing and the application number . The application number should be used in all correspondence with the Registry. The application will be processed by a trade mark examiner and he will accept or object the application.


The Registry will issue a letter if there is any objection and the applicant will be given time to submit his appeal or written submission to overcome the objection. If there is no reply to ministry's letter, the application will be removed from the list of trade marks under consideration. If there is no objection to the application, it will be gazette in the government gazette where the public is given two months to oppose the application. If there is no opposition, the application will proceed to registration and upon payment of the prescribed fee, certificate of registration will be issued in due time.

Renewal : Under the Trade Marks (Amendment ) 1997, registration is valid for the first 10 years from the date of application and renewable every 10 years thereafter.
